CHAPTER 14. TRAFFICCHAPTER 14. TRAFFIC\Article 4. All-Terrain Vehicles and Off-Road Vehicles

For the purpose of this article, “all-terrain Vehicles” or ATV’s, are defined as any motorized off-highway vehicle, 45 inches or less in width, having a dry weight of 500 pounds or less, traveling on three or more low-pressure tires, and having a seat designed to be straddled by the operator. As used in this section, low-pressure tires means any pneumatic tire six inches or more in width, designed for use on wheels with a rim diameter of 12 inches or less as recommended by the vehicular manufacturer.

For the purpose of this article, “off-road vehicles” shall include, but are not limited to three and four wheel all-terrain vehicles, go-carts, dune buggies; midget vehicles and any other motorized vehicles not required by law to have a license plate.

This article does not pertain to farm tractors or farm implements or lawnmowers, nor shall it pertain to the above mentioned vehicles when used for legitimate agricultural or oil production purposes. Further exceptions may be made through proper authorization by the City Council for parades and other official activities.

This article does not apply to an off-road vehicle that is properly registered with the State of Kansas, that has a valid license plate, and has all of the necessary lights and safety equipment required of licensed motor vehicles under the registration laws of the State of Kansas.

No all-terrain vehicle or off-road vehicle, except as noted in section 14-402, shall be operated on any street within the incorporated city limits of Lane, Kansas or on any publicly held or owned property. No all-terrain vehicle which is used for an agricultural or oil production purpose shall be operated on any street within the incorporated city limits of Lane, Kansas or on any publicly held or owned property; between sunset and sunrise. No all-terrain vehicle shall be operated for agricultural or oil production purpose by an operator that does not have a valid Kansas drivers license.

Violation of this article is a misdemeanor punishable upon conviction of a fine not to exceed $500.00 or confinement in jail not to exceed ninety (90) days or both fine and confinement.
